Trademark Search
The Patent and Trademark Office does not require a search prior to applying for trademark registration. However, conducting a comprehensive search makes sense. It's very possible that the mark you want to register is already registered or a third party has common law rights to the mark. Conducting a search prevents you from forfeiting the application fee and the preparation fee. In addition, the likelihood that your application will encounter problems is greater if you do not conduct a search.
We offer two types of searches both come with a written attorney analysis:
- US Comprehensive: A comprehensive search
which includes a search of the federal state and common
law databases and the internet domain database for £275.
A comprehensive search is recommended and is the search
most of our clients choose.
- US Clearance (or 'Knock Out') Search:
A Federal Search for £175. This is essentially
a "Knock-Out" search of the USPTO database for exact
matches. This type is most useful in determining the
availability of a proposed name when deciding among
a number of choices.
