Trademark Search
The UK Patent Office does not require a search be conducted prior to applying for trademark registration. However, conducting a comprehensive search makes sense. It's very possible that the mark you want to register is already registered or a third party has common law rights to the mark. If your application is rejected, the govt filing fees will not be refunded. Conducting a search prevents you from forfeiting the application fee and the preparation fee. In addition, the likelihood that your application will encounter problems is greater if you do not conduct a search. Searching enables you (1) to assess whether it is possible to use a trade mark in a particular territory without infringing the trade mark rights (or possibly related rights) of others and (2) to assess whether you can register your trade mark in that territory.
We offer two types of searches in the United Kingdom and each come with a written analysis:
- UK Clearance Search: A clearance search which includes a search and an analysis by a trademark agent for £125.00. A clearance search is recommended and is the search most of our clients choose.
- UK Comprehensive UK/European Union/ International Search: A clearance search which includes a search and an analysis by a trademark agent for £225.00. This search includes results found in the European Community, including UK marks and community marks. This clearance search is highly recommended if you are interested in learning about the trademark availability in Europe and also includes results for the Madrid Protocol.
