Preparation and Filing Trademarks in the European Union
In the Community Trademark (CTM) system, an applicant files a single trademark application with the Office for Harmonization in the Internal Market (“OHIM”). No home country or “basic” supporting application or registration is required. A single fee, which is generally lower than the aggregate expense of filing in four or more EU countries separately, is submitted.
For a flat fee of £350.00 (plus filing fees), a solicitor
or trademark agent will draft and file your trademark application
for one mark up to three classes with the Office for Harmonization
in the Internal Market (OHIM), within two weeks of receipt
of your payment and receipt of all documents necessary to
prepare the application. We will provide you with updates
during the application process and once registered will
advise you on the proper use of your registered trademark.
The fee includes routine consultations and correspondence
with OHIM and responding to non-substantive office actions.
If there is a complication with your application, a trademark
attorney will address the complication at a reduced hourly
rate and only after obtaining your prior approval. For certain
oppositions or office actions, arrangements may be made
with independent solicitors or agents to assist in such
matters.
The £350.00 legal fee does not include
the OHIM filing fee of €900.00 (or €750.00 for
e-filing) up to three International Classes. There
is a govt filing fee of 150 Euros for each additional class
extending
beyond the third class.
At the stage of CTM registration, an OHIM Filing Fee and Forwarding Certificate for one mark up to three classes is 850 Euros and each additional class extending beyond three classes is 150 Euros. We do not charge legal fees for registration if the initial application was filed through us. If not, our fees would be £225.00.

An outline of the application process is as follows:
- The application form is sent to OHIM, with a fee payable within two months;
- The papers are checked to ensure that they have been correctly completed;
- An examiner considers the inherent registrability of the sign as a trade mark;
- Objections, if any, are dealt with;
- A search is made for conflicting trade marks by OHIM and the majority of national registries;
- Search results are sent to the applicant but do not prevent publication;
- The mark is published in the CTM Bulletin for a three month opposition period;
- Any opposition must be dealt with;
- Once the registration fee is paid, the mark is registered and a certificate issued.
